End-User License Agreement (EULA)

1. Acceptance of Agreement

By installing, copying, or otherwise using the software titled “DrumSynth Lab” (hereinafter referred to as “the Software”), you agree to be bound by the terms and conditions of this End-User License Agreement (“Agreement”). If you do not agree with any part of this Agreement, you must not install or use the Software.

2. Grant of License

Flexbyte Software grants you a limited, non-exclusive, non-transferable, revocable license to use one copy of the Software for your personal or commercial purposes in accordance with this Agreement.

This license includes:

• Installation and use of the Software on devices under your control.
• Use of the Software only in compliance with applicable laws and regulations.

You may not:

• Modify, reverse engineer, decompile, disassemble, or create derivative works based on the Software.
• Rent, lease, sublicense, distribute, or transfer the Software or this license to any third party.
• Remove or alter any copyright, trademark, or other proprietary notices included in the Software.

3. Ownership

The Software is the property of Flexbyte Software and is protected by copyright laws and international treaties. All rights not expressly granted to you are reserved by Flexbyte Software.

4. Term and Termination

This Agreement is effective until terminated. You may terminate it at any time by destroying all copies of the Software in your possession. Flexbyte Software may terminate this Agreement if you fail to comply with any of its terms, without notice. Upon termination, you must destroy all copies of the Software.

5. Disclaimer of Warranty

The Software is provided “as is”, without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk as to the quality and performance of the Software is with you.

Flexbyte Software does not warrant that the functions contained in the Software will meet your requirements or that operation of the Software will be uninterrupted or error-free.

6. Limitation of Liability

In no event shall Flexbyte Software be liable for any damages (including, without limitation, incidental, consequential, or special damages) arising out of the use or inability to use the Software, even if advised of the possibility of such damages.

7. Export Controls

You agree to comply with all applicable export laws and regulations. You shall not export or re-export the Software or any underlying information or technology in violation of such laws.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the country where Flexbyte Software is registered, without regard to its conflict of law provisions.

9. Changes to This Agreement

Flexbyte Software reserves the right to update or modify this Agreement at any time. Any changes will be posted on our website. Continued use of the Software after any such changes constitutes your acceptance of the revised Agreement.

11. User-Generated Audio and Use of Included Content

All sounds, audio files, beats, compositions, or other audio content created or generated by you using the Software (“User-Generated Audio”) are your property. You retain all rights, title, and interest in and to such User-Generated Audio. Flexbyte Software claims no ownership over any User-Generated Audio.

Furthermore, Flexbyte Software grants you the right to use, modify, and incorporate into your own works the following elements provided with or within the Software:

• Presets (e.g., synthesizer settings, drum kits, effects configurations)
• Sample content (e.g., WAV files, loops, one-shots, and other audio assets)

You may freely use these elements — either as-is or modified — in your own musical compositions, sound designs, commercial projects, or any other creative work, without attribution or additional licensing requirements, unless otherwise specified in a separate agreement or applicable law.

Flexbyte Software does not assert any intellectual property claims over your use of presets, samples, or User-Generated Audio created with the Software. However, you must not redistribute or sell original preset or sample content from the Software as standalone assets or in a form that directly competes with the Software or its contents.

12. Open Source Components

DrumSynth Lab includes software components licensed under the MIT License. In particular, the application is partially based on code from mda DrumSynth, originally written by Paul Kellett.

The MIT License allows for free use of the software in both personal and commercial applications, provided that the original copyright notice and permission notice are included. The full license text can be found at opensource.org/licenses/MIT.
